I Want to appeal in high court of bombay

I had family related matrimony case in family court thane. The out come of case came in may 2023 and it was against me. I had no advocate in the case as lot financial issues. Came to know now that opponent done fraud and told false in the case of many types and i lost case. Is possible to appeal now. I am Hindu.

You can file an appeal in High Court within limitation (usually 90 days). If delayed, seek condonation of delay. If fraud is proved, you may also seek review/recall. Consult a family law advocate urgently.

An appeal against a Family Court order can be filed before the High Court under the Family Courts Act, 1984 within 30 days from the date of judgment. Since the order was passed in May 2023, the limitation period has expired; however, you may still file an appeal along with an application for condonation of delay under the Limitation Act, 1963 by explaining valid reasons such as financial hardship and lack of legal representation. If the judgment was obtained by fraud or false statements, you may also seek to challenge it on the ground that fraud vitiates judicial proceedings, and in limited circumstances, a review before the same court may be considered. Additionally, under the Legal Services Authorities Act, 1987, financially weak persons are entitled to free legal aid. You can approach the District Legal Services Authority (DLSA) at Thane District Court or the Maharashtra State Legal Services Authority to obtain a free advocate for filing the appeal and related applications.
