I want noc from my lawyer but asking my signature
18-Jun-2025 (In Divorce Law)
I want noc from my lawyer. But my lawyer asking me signature on documents. Do I really required sign documents if any? Also share what to send message to my lawyer on WhatsApp about Noc clearance request.
It is your right to change your lawyer. But, first, you need to clear all the lawyer's fee dues. Then, you can collect your case papers, if any, after signing for acknowledgment of the receipt of the same. Simultaneously, you can get no objection to change counsel from your earlier lawyer by getting the same on a fresh filled up vakalat for the same case.
You are not legally required to sign any document to obtain a No Objection Certificate (NOC) from your current lawyer. As a client, you have the absolute right to change your legal representative at any stage of your case. The NOC is merely a formal document indicating that your existing lawyer has no objection to you appointing another advocate. If your lawyer is insisting on a signature, ask for the purpose of the document and consult before signing. You may directly file a vakalat withdrawal memo through your new advocate if NOC is unreasonably withheld.
WhatsApp Message to Lawyer:
“Dear [Lawyer's Name], kindly issue me the No Objection Certificate (NOC) for my case as I intend to appoint a new counsel. Please confirm when it can be collected. Let me know if anything is needed specifically for this purpose.”
An NOC is typically required to confirm that there are no objections to certain proceedings, and your lawyer may be asking for your signature on documents to formalize this request or related legal steps. Whether you need to sign documents depends on the specific requirements of your case and local laws, which can vary. Generally, signing documents may be necessary to authorize your lawyer to proceed with the NOC request or to comply with court procedures. It’s advisable to review the documents carefully to understand their purpose
