I want devorce from my husband we don't have marriage certification.

Without divorcing your 1st husband if you marry it will amount to bigamy for which if allegations are proved both imprisionment and fine will be on you. So better divorce your 1st husband and marry after 90 days of the divorce decree passed.

You have to first get divorce from your present husband and then only you can re marry. If your marriage is not registered, you need to produce other proof of marriage for getting divorce. Once the divorce is done your present husband can not stop you from marrying some one else.

Yes if you are married without a marriage registration and your husband has not given divorce you can be charged for fraud and cheating him if he has sufficient proof to show that he is married to you
