Both spouses file a joint petition in family court. 2. State that you've lived apart for 5 years and mutually agree to dissolve the marriage. 3. Attend first hearing statements. court records 4. After a 6-month cooling period (sometimes waived), attend second hearing. 5. Court grants the divorce decree. If Contested Divorce: 1. You file a divorce petition citing separation/desertion. 2. Spouse is served a notice and may reply. 3. Court hearings → evidence, witness statements. 4. Judge grants decre satisfied with proof of long separation.

Well, you can easily get Unilateral Divorce now, considering your Spouse has committed Adultery while he was married with you. You send your Hubby a Legal Notice of Divorce first, if he gives, well and good, if not, then, then you can easily take a Unilateral Divorce on the ground of Adultery.
