I am married to my aunt's daughter. We have been married for 2 months, but I am not happy in the marriage. She is torturing and with her mother, she is emotionally torturing me. She is currently a month pregnant. I have heard that our marriage is not valid under Hindu law because we are too closely related. Now I am convinced that we can not live together, as she is completely under control of her family. What are the implications of this for our marriage? What is the procedure for divorce?

if you are marriage is and arranged marriage it is quite possible that the customs and traditions of your family permit the marriage between the close relations therefore your marriage with your aunts daughter is valid in The Hindu Marriage Act. you can on the basis of mental cruelty but the divorce petition can only be file after laps of 1 year of the marriage. The divorce petition can be filed before laps of 1 year of marriage only on the extreme based grounds.

if she is ready to give you the divorce by mutual consent go for the mutual consent and if she is not giving you it by the mutual consent then we have to file the contested petition under cruelty against you
