I am a 30-year-old Hindu Maharashtrian man who has been married for five years and has not had any children from this marriage. I have tried my best to make it work, but I have become fed up with the ongoing quarrels and lack of companionship with my wife. During the COVID pandemic, we lived separately for almost 2.5 years, and then she came back to my house in August 2022 for her sister's wedding. Since we cannot stay together because of our issues and cannot live under one roof, I have decided that it would be better for us to separate instead of continuing to experience mental anguish every day. Despite not wanting to be with me, my wife is not willing to agree to a mutual divorce, and my parents are pressuring me to stay with her to uphold our social standing and appease our relatives. I have done this for five years as per my parents' wishes, but now I can no longer continue living with her, so I have decided to live separately or file for divorce. Can you please advise me?

you can file for divorce on the grounds of cruelty and desertion. if your wife is not ready and willing to give you a divorce it's better if you file a contested divorce petition before the family court and call upon her say on the petition.

If you are happy living separately from your wife, you can continue that without opting for divorce. However, if you feel it is better to end this marital relationship, you can send her a notice for divorce. Mutual divorce is the quickest way to end a relationship since there is mutual understanding on all terms of marriage. However, if in your case your wife is unready for mutual divorce, then you have to go for a contested divorce.

Dear Queriest, as you have mentioned that you are staying separate and want to file divorce, if you have already decided then you can file divorce staying under one roof itself, you can file divorce under section 13 of the Hindu Marriage Act under the grounds of cruelty and other related to it. for more information about the same feel free to contact me.
