Husband not staying with me how can I claim rent of the house

Me and my husband staying in a rented flat.the lease deed is on both of us name but i am a house wife and my husband dont want to live with me so last 15 days he is not staying at home and warn me to pay rent.i am not working.my question is does my husband kick me out of the house or me also responsible to pay rent if i am not working.thanks

It is rather unfortunate that you find yourself in this position, however, the lease of your property requires the tenant in the property to pay the rent irrespective of the fact that your husband does not wish to be a cohabitant with you in the rented premises.

That said, you are entitled to maintenance from your husband, and he is legally bound to provide for your livelihood. We advice you to consult a competent lawyer to guide you through the process.

You are in a difficult situation now, normally lease does not involve rent to be paid monthly, eitherways, pl.confirm with the land lord about the position or see the lease deed and get clarified. If it is to be paid monthly somehow manage to pay monthly rents seeking u r parents help/friends, you can also file a petition for restitution of conjugal rights if u want to live wiht u r husband, else u can file for divorce and seek monthly maintenance in that case as u r not working. You can also file domestic violence case if he has physically harmed u.
