Husband not providing proper maintenance what can be done

Hello I want to ask that our marriage held 5 yrs back .I have tourchered by my mother in law and frequent fight wit me.so indirectly my husband is taking side of my MIL . after 2 yrs my husband taken another house for me n my child he use to come only Saturday n Sunday to my house day by day we also have fights regarding not coming to house regularly n not giving financial support not taking care of child etc.. since 6 month I stay in my mom's house n he doesn't contacted us still. whta action can i take aciton against them

In this situation, you can file 2 maintenance cases one in civil court and another in criminal court under domestic violence act where you can ask for maintenance, residence order or rent amount , protection order, etc. In near about 4 months you would start getting your maintenance amount... You can file a case against your husband for maintenance under section 125 call criminal procedure code and under section 24 of Hindu marriage act. And you would get maintenance as per his and your standard of living.

you can file criminal application against your husband and IN-LAWS, Under the provision of DV act, and can get lumsum amount for maintenance or monthly alimony,
you can add following sums to your maintenance
1) House Rent (if rented) or otherwise taxes, light bill etc..
2) Medical bills for you and your children
3) Monthly Education and other expenses for child.

Dear client u can ask monthly maintenance for u and child from husband by filing case under sec 125 of criminal procedure code. Also u can file domestic violence case against husband and mother in law for mental harassment. For any legal help call me
