Husband not providing maintenance. How to get divorce?

last few years he has not provided anything to me or my kid. I lived at my father's expense. Now my father is ill and weak and it's high time I do something. Can my marriage be dissolved as I have no connection with him for the last few years. I don't need a police case as it might hinder my job abroad. He is not willing for a divorce or a mutual consent one too. Please help me.

Its now a days had become common n pathetic tat husbands desert wife n kids. Especially kids. But wat i belive n can draw out from ur query is tat there no big issues betwen u two. So besides thinking f a divorce think abt ur kid. Think about 10 years from now. How urs n kids life will b. may be its a communication gap problem which can b mented back better.
N still u think the other way cuz u r the only person who suffered n shed tears its time to meet ur lawyer.
We dont need his consent for getting divorce n maintainance. Wat the law states tat until he is alive n u remarries someone u r entitled to get maintainanceTO THE STATUS OF HIS LIVING WATEVER THAT BE. So as for the kid. Any way wish u the best n meet a lawyer of ur locality

You should not go to divorce straight. First you file a case against him for the maintenance of you and the child before the family court where you reside.Definitely he must appear before the court for further procedure.There you will get the chance for divorce.
