If you have a right to live in the matrimonial home with him and in case he doesnt allow file complain with police and meet protection officer to file domestic incident report. In the case you want to file for divorce consult an advocate. In any case your facts and title are confusing as to what you want.

As you got married under Hindu laws , you can file marriage petition u/s 9 for restitution of conjugal rights that means you can ask him to take you back to matrimonial home but you can ask him to live seprate from his family

If your husband is not living with you and if you both are leaving separately then you ask him for maintenance in order to support yourself and your child. If you ask him for maintenance then he might either leave you or he will start staying with you. Even if it reaches at the stage of divorce then you can also ask for maintenance from your husband.
