Husband lying about income to reduce maintenance amount,can I file RTI

My husband is having cosmetic shop earning abt 40-50k monthly. As now i have filed maintenance case he is saying that he is not having his shop n his father is working at that shop. I know he is lying in court .He is saying he is doing job at another shop getting 6k monthly n paying rent of house4k. all thing is lying in court.plz give me advice hw to proof his income? cn rti help in getting income of self employed?

Yes you can file RTI , you can get details of the shop if its self owned or rented, registered with BMC under shops & establishment. Get details from where he sources his products etc , finally his IT returns.Check www.divorcewhammy.com

As per section 125 of crpc wife has a right on property and earnings of husband but no right on the property and earnings of his parents if that shop owns by his father then you are unable to to get maintenance on the basis of income of that shop,it is 100 percent right he owns that shop and earns what you detected, but unable to prove which he owns .from the Judgement of Arnesh Kumar vs state of Bihar a case of 498A now a days courts also
showing sympathy towards male candidates.maintenance cases fully run on sympathy and lay factors, by dialogue if I get more information just education, health conditions, conditions of your parents, it will be easy for me to guide specifically. thanks

You can try to get the information by any way , RTI is your rights you can utilise it and if the company is not giving the details then you can take the court order for sharing your husband salary information
