Husband desserted not giving divorce dont want to give maintenance

3 yrs maried life. No child. Severe torture from in-laws. Husband deserted me. He wants me to stay with them. He is not ready to file divorce bcoz of fearing maintenance. I cant live with them. I want divorce. Will i get maintenance, if i file divorce?
you can file a petition before the family court seeking divorce on any of the grounds contemplated under section 13 of Hindu Marriage Act. You can also claim interim maintenance to be paid by your husband during the pendency of the divorce petition. You can file divorce petition on the ground of cruelty among other grounds. Amount of maintenance depends on the income of your husband and number of dependents on him.
