husband deserted having extra marital affair need divorce

I am an Hindu,married for almost 3 years and have a daughter of 1 1/2 years.my husband deserted me for past 1 year since he has extra marital affair,other issues are dowry demands and husband family chased me out from their home with child and threatened to murder.How to proceed for divorce and get permanent child custody and settlement from him sooner ?

You have to file a divorce case along with maintenance and interim maintenance. And domestic violence case against your husband and his family. Moreover you have a daughter so he cannot take ur daughter away from u.

You can file a petition for divorce on the ground of cruelty and get divorce. Regarding permanent custody, you are already having custody so you need not file any petition. Also till your daughter is 5-6 years, the Court will not allow your husband to get custody of your daughter. So dont worry about it. You can file petition for Dowry harassment and Domestic Violence Act etc, if you are planning to apply for Divorce.
