Husband and wife disputes - dowry

22-Sep-2025 (In Divorce Law)
After being constantly harassed by her mother-in-law over dowry, my sister left her husband's home 10 months ago with her two children. Her husband, who was unsupportive, recently filed a police complaint against her and our mother, claiming they refused to return home. During the initial police inquiry, the police seemed to side with her husband. My sister fears for her mental health and wants to live separately with her husband, but he refuses. She needs time to heal, next hearing 30.09.2025.

Mum I've gone through the brief note of yours please advise your sister that she may not go to the station this is a civil matter that a family matter police doesn't have any jurisdiction Police can call and advice on a good faith but they cannot take sides and they cannot do if a police call tell them I'm not prepared to come to the station whatever they wanted to Do let them do it to the court family court okay so tell her not to worry everything will be in favour of your sister so therefore tell her to approach the right advocate and send a notice about what domestic violence has done then I think whoever is close to your locality jurisdiction they should be able to guide you okay thank you

Dear Client, 1. Your sister can file a case under the Domestic Violence Act for protection, residence, maintenance, and custody of children. She can also file a complaint under IPC for dowry harassment. The husband’s complaint is weak since she left due to cruelty. 2. In court, she can seek judicial separation or divorce and request interim custody, maintenance, and residence orders for herself and the children until the final decision. 3. Consult an advocate to discuss your case in brief. 4. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

This appears to be a civil dispute involving family law and dowry harassment. The police's role is limited in such cases unless there is clear evidence of a criminal offense. Advise your sister to consult a lawyer to contest the police complaint and seek legal separation if needed. She can present her case in court,Encourage her not to worry and to focus on gathering evidence and legal support.
