How to divorce husband who is cheating on me

I want divorce from my husband but he don't want. I m Dr. I get mentally tortured by my husband n mother in law. I'm hindu. my husband may have an affair but I don't have any evidence. We had done love marriage. We have a baby child of 3yr old. My parents does not support me. What should I do.

File the complaint against your husband and mother in law before women cell under section 498A IPC regarding the torture created on you specifying the dates when the incident happens to you and also file an application under section 125 cr.p.c for claiming maintenance from your husband for yourself and for your child

1. You may file a petition of divorce before family court under section-13 of the Hindu Marriage Act, 1955, but you will have to prove his extra marital affair or his conduct of cruelty against you.
2. If mental torture by your husband and mother-in-law is persisted in and is of a grave nature, you may file a police complaint under section 498A of IPC.
