how to challenge family court order ?

12-Mar-2023 (In Divorce Law)
My uncle filed a divorce petition on the grounds of mental cruelty. The Family Court rejected the divorce petition stating that refusing to cook food and taking care of in laws does not amount to mental cruelty. Uncle then made an appeal before the Hon’ble High Court of bpmbay challenging the order of the Family Court. Whether the Hon’ble High Court has the jurisdiction to entertain the current petition? If yes, then under which section?

Yes, the Honourable Bombay High Court has the Original Civil Jurisdiction under Sec 28 of the Hindu Marriage Act to entertain appeals of the Aggrieved Parties being aggrieved by the Decrees passed by the Honourable Family Court. If your Uncle is Hindu, then I have mentioned the Right Section and Right Act.
