how marriage under degree of prohibited relationship is invalid

Hello sir, M from maharashtra.i friend got married with her father's sistet's son b4 2yrs ago.actually the boy make her emotional and take her sign on 100Rs.bond paper & two witnesses only fron boy's side n make entry in district court register at the same day.they both r above 21 years.she doent want make any issue in society but d boy now blackmailing her.pls give us d solution if it is possible to cancle without making any major issue. Bcz she doesnt want prblms in their family relation n their lives also..

The marriage is not valid according to Hindu Marriage Act and Special Marriage Act and it is unlikely it has been registered under Special Marriage act.To stop the blackmailing she should immediately file a complaint with the nearest police station and on her request they will handle the matter sesitively keeping it confidential and not informing her parents as she is an adult, further she can file a Petition in Court for a decree of nullity.

Hi you can file divorce case on the ground of nullity on marriage before family court. If you are staying separately for 2 years or more file on ground of desertion. You can also file police case to force him if possible for you.In both case you have to file a case in court.

As both are major and sound mind not disqualified by law then marriage is legal. If she is not happy with that boy then she can file divorce case in the court of law in order to dissolve the marriage.
