The time it takes to get a divorce decree after the divorce judgment in Saket Family Court can vary depending on several factors, such as the complexity of the case, the workload of the court, and the judge assigned to the case.

In general, it can take anywhere from a few weeks to a few months to receive the final divorce decree after the divorce judgment in Saket Family Court. However, it's important to note that the timeline can be affected by various factors, such as the number of pending cases before the court, holidays, and the availability of court staff.

How Long After the Second Motion for Mutual Consent Divorce?

  • After both parties appear for the second motion (the final step in mutual consent divorce), the court usually takes 45 to 60 days to issue the divorce decree.

  • However, this timeframe can vary based on:

    • Court workload

    • How quickly the judge signs the order

    • Any clerical delays in issuing the certified copy

When Is the Divorce Legally Final?

  • The divorce is legally effective from the date the judge passes the decree, not when you receive the physical document.

  • You can apply for a certified copy of the decree for your records once it?s signed.

What If It's a Contested Divorce?

  • Contested divorces (where the parties don?t agree) can take much longer?1 to 3 years or more, depending on:

    • Number of hearings

    • Evidence and witnesses

    • Appeals or delays

What About the Six-Month Cooling-Off Period?

  • In mutual consent divorces, there is usually a 6-month cooling-off period between the first and second motion.

  • However, this period can be waived by the court if:

    • The couple has already been separated for 1+ years

    • Both parties genuinely want to end the marriage without delay

The final decree is prepared within one month from the date of order of divorce. If there is a specific direction against the party who is not appearing, you can file a conyempt petition before the appropriate court. Further assistance can be provided after going through the documents.

Your query is not clear wether divorcee was filed on the ground of mutual consent or on some other ground..but stated position is.. In Delhi District Court Mutual divorce is granted by two motions. In first motion you have to file petition where judge record the statement of the parties and pass first motion and after 6 months second motion has to be filed in form of petition like first motion ,stating that first motion has been passed....again judge record statement of the parties and then pass second motion and pass decree of divorce.....without filling second motion judge doesn’t pass decree of divorce...therefor you have to file second motion....
