How is the maintenance in a 125 case decided by the court?

498a filed by wife After 2 months I filed for divorce ABP still on progress Interim Maintenance ?? My cash in hand salary 45000 Wheter Maintanance fixed on cash in hand salary or gross salary If I have a personal loan paying 16000 per month Then ???Maintanance ??? I have a baby girl but she is with wife rt now Suggest me in detail about Maintanance Personal Loan ,old parents,personal expense ,etc etc
Their is no straight jacket formula in law to calculate monthly maintenance in cases of 125 cr.p.c.while deciding the same old age of parents generally not considered.personal loan is also having no relevance.gross salary is to be taken into consideration.amount is determined considering the social status of both parties and other like factors.

you can convince in detail before the court about allyour responsibility and liabilities..court will considered these liability like duty towards parents but same time to maintain your children and wife if she is not earning , than you have to maintain her.
