How Get Divorce after 15 year of Separation, I don't know where my husband, his family always telling me that they don't know. I am leaving vanaprastha life in ashrams. Kindly guide me. I am in Delhi now, bt marriage held in Punjab

Yes, after 15 years of no contact and no known whereabouts, you are entitled to seek divorce on the ground of your husband being unheard of (presumed dead). The law has made clear provisions for such circumstances. Grounds under the Hindu Marriage Act, 1955 (if she is Hindu):- Section 13(1)(vii): If the spouse has not been heard of as being alive for a period of seven years or more by people who would naturally have heard of them if they were alive, it is treated as a valid ground for divorce.

You can file for divorce even if you don’t know your husband’s whereabouts. Since you’ve been separated for 15 years, you can file a petition for divorce in the Court. The Court will issue notices to his last known address, and if he doesn’t appear, service can be done through newspaper publication. The case can proceed ex-parte if he still doesn’t contest.
