How can my sister quash 498A case against my brother in law

14-Jul-2023 (In Divorce Law)
My sister has filed a 498 case against her husband in year 2007. The cross examination of my sister is pending. Now we want to settle this case. The opponent's lawyer suggest us to not file 482 for quashing in the High court. He suggest us another alternative- he would ask some simple question to my sister in trial court on the next date and also would provide answer of those questions one day before. The answer would be in such a way that no punishment would be granted to my sister's husband. My doubt is - Is it a safe option or should we go for section 482 for quash in the high court.

Go and file petition under section 482 and get the matter quashed. Even if trail has gone to later stage then also High Court will quash the same looking to the fact that the case is of s 498A IPC.
It's a safe and reliable method to get the matter resolved.

Advise:

taking evidence/cross examination in lower court will take time and court will call other witnesses as well for their evidence irrespective of your sister's cross examination. the best way is to file a 482 quashing petition by the accused and in the same you sister may file affidavit that she do not want to pursue the criminal case as they have compromised. The HC will quash the entire case in one go.

we do such type of cases.
