Your daughter has been separated since 2015 and her husband’s contested divorce case filed in 2022 is still pending. The most effective and faster way is to convert it into a mutual consent divorce under Section 13B of the Hindu Marriage Act, 1955, where both parties can agree to dissolve the marriage peacefully. This route avoids lengthy trial, evidence, and witness examination and ensures an early decree by the Family Court.

Since the parties have been living separately since 2015, the easiest and fastest way to obtain divorce is by mutual consent, provided both husband and wife agree. They can convert the pending contested divorce case into a mutual consent divorce under Section 13B of the Hindu Marriage Act.

Based on the facts stated, the easiest and fastest option would be to convert the pending contested divorce into a Mutual Consent Divorce under Section 13-B of the Hindu Marriage Act (or corresponding personal law, if applicable). Since the parties have been living separately since 2015, the requirement of separation is already satisfied. If both husband and wife agree, a joint petition can be filed mentioning that your daughter is waiving alimony/maintenance voluntarily. Courts routinely accept such settlements. Alternatively, if the husband is not cooperating, your daughter can file her own divorce petition or seek early disposal/mediation in the pending case. She may also move an application for expeditious hearing citing long separation. However, it's advisable to connect in order find the best solution.
