How can I add more points in the petition regarding child custody

27-Mar-2023 (In Divorce Law)

I was made to sign mutual divorce by telling he will rethink and child support and all were not discussed. What are the clauses to be added for child custody like remarriage of mother, visa permission in case of reallocation to another country? If we need to make changes in the petition, can we add it on existing or file a new one and wait for 6 months?

As per your query, if the first petition has been filed then no changes can be made to the petition and you'll have to file new petition in order to add the clauses you wish to add but, if the petition has not been submitted by the court then you can make amendments to the existing petition.

What do you mean by "I was made to sign mutual divorce"? A petition for mutual divorce should be signed only on informed consent. Had you consulted your advocate before signing the papers?

Anyhow, if it is the case that your consent was not neither informed or voluntary, this could be agitated at any stage of the proceeding. Only those aspects arising from the marriage alone need to be incorporated therein. As far other aspects are concerned, they are your ordinary rights, and hence need not be mentioned.
