Harassment and domestic violence by father, what action can be take?

My father badly treats my mother. He abuses her both psychologically and physically. my mother has been a subject to this for a very longer period of time. recently he beat her brutally and despite her whining and requests to spare her he continued. that i was informed a day later as i live far from home. upon seeing her i decided to leave for my maternal home. i did not file an fir there as i was perplexed at the situation. my maternals reside in a different stateM.P and the place of crime was a different stateBIHAR. my mother filed an FIR in MP. and we do not have proof of any physical injury except for a few call recordings which consist of threats from him. and he also threatens me to come to my university premises and disturb if i do not bring back my younger brother to him. but he does not want to go to him. in fact none of us. suggest a remedy. i am a hindu.

Your mother can go for the domestic violence case against your father & subsequently ask for maintenance case against him. You guys not required to go there with him at all & if you & your yunger bro is below age of 25 years you can also claim maintenance against you father for yoursurvival.

File an FIR against your father at the place where the crime of s. 498A was committed. Your mother may also take divorce from you father if required and also file a complaint under domestic violence act. Do not fear from the threats of your father. Complain about it as well to the police.
