17-Jul-2026 (In Divorce Law)
Me and my wife jointly bought the property and now our matrimonial relation not good. Now I am planning file a partition suit of the property. For 5 years I paid the EMI now she is paying from 6 months. As the property is under bank loan. My question is: Do we need implead the bank. If yes without giving notice also can we implead or do we need to implead after serving proper notice to bank.

The issue involves important questions relating to co-ownership, mortgage rights, and the maintainability of a partition suit. The answer depends on the title documents, loan agreement, and the relief sought in the suit. A proper legal opinion can be given only after examining all relevant documents and the facts of the case.
