Girl not willing to give divorce but had signed an agreement?

i am planing to marry a man who got married 4 years back to a girl. the girl is going out with other men. she signed some agreement as well. we have some proof as well where is is sex chatting with a boy. wht is the remedy she is not ready to give divorce? how can we get married?
He has to get divorce (through Court) to married again. If he marries you, your marriage with will be null and void. Agreements of divorce are valid.
Ask him to approach court for divorce. Get married with him only after the order of dissolution of his marriage comes to finality.
