For mutual consent divorce, a year long separation is required and then you can proceed. Thereafter, you can proceed to file for divorce which takes 3-6 months of time. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Both must genuinely agree that the marriage has irretrievably broken down and cannot be reconciled. All major issues must be settled in advance: alimony/maintenance, child custody (if any), visitation rights, and division of property/assets.

You can file a mutual divorce if both parties consent and have been separated for at least 1 year. File a joint petition, record statements (first motion), wait 6 months, then second motion for decree. Documents: marriage proof, Certificate, photos, settlement terms.
