In a divorce case, there is generally no automatic “wealth distribution” between husband and wife under Indian law. However, a spouse may claim maintenance/alimony depending on factors such as income, financial needs, standard of living, duration of marriage, and other circumstances. For permanent alimony, the court may consider the income and property of both parties. If there are jointly owned assets, the ownership documents and each person's contribution may also be relevant. The wife may have independent rights in property jointly owned or legally transferred to her, but she does not automatically get an equal share in the husband's self-acquired property merely because of divorce. It is advisable to review all assets, income details and marriage circumstances before filing or contesting a claim for alimony.

Every matrimonial and family dispute is different. A divorce petition, whether mutual or contested, cannot be properly prepared merely on the basis of general circumstances. It depends upon the complete facts of the marriage, duration of matrimonial relationship, conduct of both parties, family circumstances, children, financial position, separation, previous legal proceedings, and other relevant facts. I carefully examine the marriage circumstances, family background, matrimonial disputes, supporting documents, and legal position before suggesting the appropriate remedy. Depending upon the facts, the matter may involve divorce, maintenance, child custody, domestic violence proceedings, restitution of conjugal rights, judicial separation, protection proceedings, or other appropriate legal remedies. The right legal strategy starts with understanding the complete facts of your case. A proper petition must clearly present the facts, grounds, evidence and relief required, while protecting your legal rights and interests.

I can assist you with the divorce filing process, including understanding the grounds for divorce, jurisdiction, required documents, and the procedure for filing. I can also guide you regarding division of matrimonial assets/property, maintenance or alimony, and other financial rights. The outcome of wealth distribution depends on factors such as the nature of the assets, ownership, duration of marriage, income of both spouses, and applicable personal laws.

You may seek divorce under Section 13 of the Hindu Marriage Act, 1955, subject to the existence of a legally sustainable ground and fulfilment of the statutory requirements. The issues of maintenance/alimony and distribution of assets are separate from the grant of divorce. With respect to alimony, the Court may consider interim maintenance under Section 24 and permanent alimony under Section 25 of the Hindu Marriage Act. The amount is not automatic and depends upon factors such as the respective income and financial capacity of the parties, their standard of living, needs, liabilities, duration of marriage, and other relevant circumstances. Regarding wealth/property distribution, Indian matrimonial law does not ordinarily provide for an automatic 50:50 division of the husband’s or wife’s assets merely because the marriage is dissolved. The nature and ownership of each property, source of acquisition, contribution of the parties, and applicable personal/property law have to be examined separately. Stridhan and individually owned property are also treated according to their distinct legal status. Therefore, before filing the divorce petition, it would be advisable to examine the marriage documents, details of movable and immovable properties, income-tax/income records, bank accounts, loans and liabilities, and the financial circumstances of both parties. A proper assessment can then be made regarding divorce, maintenance/alimony and any appropriate property-related relief.
