Filing a divorce with no marriage certificate in India

08-Apr-2024 (In Divorce Law)
Hi Lawyer, I got married in India but we havenot registered for marriage certificate at the time of marriage, later we moved abroad and got married abroad to get the marriage registration for visa issues. We have to minor children born at abroad but I want to file a divorce because of the bad behavior and irresponsibility of the spouse. Could you please suggest me if I still file a divorce while I'm in India and the spouse is living in abroad?

You're married abroad because of Visa compliance, in the eyes of law. So respective foreign laws would be applicable. Indian laws do not recognise your rituals unless applied for registration of marriage, with proof. In your case, you'll have to apply for divorce as per the foreign laws , as applicable.
