Filing a divorce under section 13 a for cruelty

I want to file a divorce case against my husband under section 13 1 i a under cruelty.But we have stayed away for 11 months now. Can i file a case against him as still the separation period is not a year.

you can file a contested divorce petition irrespective of the period of separation. it is necessary in such a case that you lucidly mention the grounds of divorce so that the same can be contested under section 13 1 ia of The HMA.

Yes you can file a divorce petition against your husband for cruelty.
The separation period is already 11 months and the drafting and filing of the divorce petition will anyway take atleast a month time.
