Dear Client, 1. Your wife has filed for divorce on the ground of mental cruelty based on her suspicion that you had a previous relationship and that the girl visiting your home means you were already married. Merely having a past love affair before marriage is not illegal and does not amount to cruelty unless it continued after marriage or affected marital life. Likewise, unless there is proof that you have contracted a second marriage under Section 494 IPC (bigamy), the allegation of “already married” has no legal basis. In your written statement, you should clearly state that the past relationship ended before marriage, the girl’s visit was unrelated, and there is no second marriage. Submit evidence, if any, to show there was no ongoing affair after marriage. The case will depend on proof, and unsupported allegations generally do not stand in court. 2. Consult an advocate to discuss your case in brief. 3. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

Yes you have legal remedy, dont stress and worry . She doesn't have any proof to confirm her allegation that you already married . Because you weren't married and of course you said that you had love affair but before marriage.. it is common, for cruetly ground there are lot of segments has to be proved.

From the facts stated, there is no legal issue merely because your past acquaintance visited your home before marriage. A previous relationship does NOT amount to cruelty or prove a second marriage. Your wife must prove her allegation of “already married” with valid documentary evidence, which is unlikely if no such marriage exists. You can file a detailed counter statement denying all allegations and place your own evidence such as messages, dates, and witnesses to show the relationship ended earlier. If needed, you may also file for restitution of conjugal rights or contest the divorce on merits. No criminal case can be made without proof of a second marriage.
