Since you do not remember the husband’s details place of marriage or the documents executed at the time the first step is to trace and verify the marriage records before deciding whether divorce or annulment is legally maintainable. Once the marriage and parties are established a matrimonial advocate can examine whether a petition for nullity or divorce is the appropriate remedy depending on the circumstances of the marriage and the applicable law.

*1. For Divorce / Annulment:* You have 2 options: a) *Declaration that marriage is void:* If no proper ceremonies as per Section 7 HMA (Saptapadi) were performed and only a document was signed, you can file for declaration of nullity. b) *Divorce on ground of desertion:* Under Section 13(1)(ib) HMA - if husband left immediately after marriage and did not stay for even 10 days and there is separation since 2008 (more than 2 years), it is a strong ground for divorce. *2. If you don't remember details of marriage:* - Check your passport for 2008 travel history to India - city of entry. - Arya Samaj Mandir generally issues a certificate. If you have any photo or copy of that certificate, place of marriage can be traced. - If no details are available at all, you can still file divorce on basis of your last known address or your current place of residence after making affidavit of best efforts. *3. Jurisdiction:* You can file petition in India where marriage took place or where you last resided together or where you are currently residing in India. If you are residing outside India, you can file through Power of Attorney holder and give evidence via video conferencing as permitted by family courts now.

Since you don’t remember the date, place, husband’s details or documents, you should first approach the Arya Samaj Mandir in which state you got married, check out with all Arya Samaj Mandir in that state and from there only you can get details of husband. Once themarriage record and jurisdiction are established, a family law advocate can guide your for divorce proceedings under section 19 of Hindu marriage act.

Firstly, you need to know that registration of a marriage either in Arya Samaj Mandir or before a registrar of marriage is not necessary to prove a marriage. The year of marriage would also do. However, it is quite not believable that the girl doesn't know the place of marriage or the date. I'm sure she remembers the place of their last residence together as husband and wife. Even if the girl has a marriage picture of her with her husband that would still prove the marriage in order to seek divorce. This is the platform where advocates reply to your legal queries. In order to apply for divorce, you may hire an advocate of your choosing either from this industry or some other. Good luck!

Hi there, for obtaining a divorce, the documents/proof relating to your marriage at the Arya Samaj Mandir can certainly be relied upon. If the formal marriage documentation is incomplete or unavailable, the matter may be more challenging; however, depending upon the circumstances, the matrimonial relationship and marriage may also be established through evidence of domestic relations, cohabitation, photographs, communications, and other relevant circumstances. That said, the appropriate legal strategy will depend upon the specific facts of your case, including the nature of the marriage, duration of the relationship, period and circumstances of separation, and the documents/evidence presently available. Therefore, it is advisable to contact me and provide the requisite details and available documents so that I can properly assess the matter and advise you on the appropriate legal course.
