You can either file for a divorce by mutual consent if your wife is also on the same page about annulment of marriage or you can solely file for a contested divorce petitioner under Indian divorce act and state grounds such as cruelty to get a favourable order of separation from the court.

1. Mutual Consent Divorce – under Section 10A of the Divorce Act, 1869, both husband and wife can jointly file a petition for divorce after completing two years of marriage if both agree to separate peacefully. 2. Contested Divorce – if your wife does not agree, you can file a petition under Section 10 of the Divorce Act, 1869 on grounds like cruelty (mental or physical), desertion, or refusal to cohabit. Lack of physical relations, constant quarrels, and neglect of marital duties amount to mental cruelty as per various judgments of the Hon’ble Supreme Court.
