Petition for obtaining divorce by mutual consent can be filed when both the husband and wife intend to obtain divorce. in this case you can decide and mention the issue regarding custody of child as well as maintenance for your self and child

Dear queriest if you want to file divorce mutual petition According to Section 13-B of the Hindu Marriage Act, the husband and wife must jointly file the petition in the Family Court with jurisdiction to grant the divorce by mutual consent. The terms of getting a divorce by mutual consent and filing for divorce are specifically mentioned in the statute
