Hello, unfortunately, I have to answer your query in negative, i.e. if the marriage has not been performed under the Special Marriage Act, 1954. You can only approach the Family Court, if the marriage was performed and registered under aforesaid act, or if you want to seek judicial declaration of divorce, which has been performed under Sec.2 of Shariat Application Act, 1937, i.e. by giving Talaq-e- Hasan, Talaq-e- Ahsan.

Yes, you may approach the appropriate court to initiate divorce proceedings under the Dissolution of Muslim Marriage Act, 1939, provided that the facts of your case fall within the legally recognized grounds mentioned under the Act. Although Muslim personal law traditionally provides for divorce through Sharia procedures, a Muslim husband is not legally restricted to those methods alone. If you wish to seek a divorce through the court system rather than through traditional Sharia processes, you may do so by filing a petition for dissolution of marriage, citing the specific grounds that apply to your situation. The court will consider the relevant statutory provisions, the circumstances of the marriage, and the supporting evidence before granting a decree of divorce. This legal route ensures that the dissolution of marriage is formalized through judicial authority, providing clarity and enforceability with respect to rights, obligations, and any ancillary matters.

A Muslim man can approach the Civil Court (under Section 9 of the CPC) for a declaration of dissolution of marriage, relying on Muslim Personal Law principles, without first giving Talaq as per Shariah.
