At the time of counselling for divorce is your lawyer necessary to be present over their like is it compulsory for lawyer to be present over their for counselling with the client. Also what if the father doesn't give maintenance for kids after the counselling and says to take from the court and the court hearing counselling date is after 3 months so what to do to get a maintenance for the 3 months now as husband is not giving any maintenance for his own kids.

while counselling advocate is not allowed to sit in counselling he has to just wait outside but after counselling what has been done in counselling has to be informed to your advocate. but in counselling your husband has told that he will pay you the maintenance but he is not giving you maintenance then you have to press for your maintenance with your divorce petition. also if it is mention in your counselling report that he is ready to give a maintenance but still he is not giving you maintenance has to be highlighted

At the time of counselling, advocate is not required. In fact, the counsellor does not allow advocates of husband and wife to be present in the counseling room since the counsellor discusses the dispute between the parties in private. You have to ask for maintenance for children from the court. You cannot get maintenance from your husband without an order. Make an application to the court for grant of maintenance to your children through your existing advocate, if any.
