Father in UAE refuses to provide for wife and kids

26-Oct-2025 (In Divorce Law)
I need a legal advice for a family maintenance case for my mother. My father works in the UAE and has stopped all financial support for 4+ months. My mother is a dependent homemaker. We have an urgent need: my brother's college fee of ₹70,000 is due, and my father refuses to pay. My father claims to be broke, but he runs an unregistered business, and his visa is expired. We believe he is deliberately evading his responsibilities. We want to file for interim maintenance immediate

You can file a petition for maintenace before the family court having jurisdiction and also applications before magistrate court. You can also file applications for interim maintenance against him till the disposal of the case

You can immediately file a petition for maintenance under Section 125 CrPC (or under the Family Courts Act, depending on the State) on behalf of your mother, along with an application for interim maintenance citing the urgent financial need, especially the pending college fee. Your father’s stay in the UAE, expired visa, and unregistered business do not excuse him from his legal duty to maintain his wife. The court can order interim monthly maintenance based on his earning capacity and lifestyle, even if he claims he has no income. If he continues to avoid payments, the court can issue warrant, attachment of property/bank account, or LOC. Keep proof of his job/business, expenses, foreign stay, and refusal to support to strengthen the case.
