Family court matter of separated hus and wife

26-Feb-2023 (In Divorce Law)
My husband filed two petitions at a time. Restitution of conjugal rights in 2021 in the family court of one District. Divorce petition in 2022 Jan in another family court of another district. Now two cases are running. Is it possible to file both cases simultaneously?

It is possible even though it is inconsistent. If both cases conduct simultaneously there is a chance of passing conflicting decisions You have two options file a Transfer petition before high court to transfer a case from one court to other court Or file a petition to stay subsequent case if the matter in issue same in both cases

You can approach the high court to transfer the matter to the nearest you. If any one of the above-mentioned Courts is nearest to your current residence. One thing you can do in this case, you can either submit it before the court where the Restitution of Conjugal Right now the petition is pending that your husband also filed a case before another Court for divorce or approach the High Court. You can complain and file 498A case, the maintenance case, and the Domestic Violence case also.
