Extra marital affair and domestic violence want my husband

We have been married for 1 year. On September 8th, my husband left me after a fight. He hasn't come back yet. Today, I found out that he is in a relationship with another woman. He says he doesn't want to live with me but I want to live with him what should I do?

If you genuinely need to reconcile irrelevant to your differences and the affair that your husband is involved now; initially try for amicable approach rather than court process or proceedings; however, if that doesn’t work out or if you wish to proceed legally, you have to file a Restitution of conjugal rights petition before the family court, at your jurisdiction. And express your intent to cohabit along with your husband with him. And for your information, amicable approach is the best option to resolve this, and if he still doesn’t agree to cohabit with you, then you have to decide the alternate option rather than requesting him.

Dear Client, 1. Legally, you can file a Restitution of Conjugal Rights (RCR) case under the Hindu Marriage Act, 1955, asking the court to direct your husband to live with you again. If he refuses or continues the relationship with another woman, you may also consider filing for divorce on grounds of adultery and desertion under of the same Act.
