Ex-wife not co operating to close the 498a and 420 cases (filed on me)

22-May-2025 (In Divorce Law)
I have got Divorce after Mutual consent Divorce petition (after the agreement). This agreement is part of Mutual Divorce Certified copy. In the agreement, Ex-wife agreed to cooperate to close the cases (498a, 420) which are filed on me and my family. I have filed quash petitions in High court for both the cases (upon submitting Certified copy of Divorce court order). For 420 case: We have received attendance exemption order. What needs to be done to quash this case at high court ?

in your case the high court Can quash criminal proceedings under section 482 CrPC. here you have already filed a quashing petition for both cases for 1980 and 420 . you must be clear, where your ex wife agreed to co-operating closing the cases or not. is the dispute settled amicably or not? first you get an affidavit from your ex wife stating she has no objection to quashing the case. here you already have an exemption order from the trial court . the High court is likely to quash the 420 case if the settlement is proved genuine. you may need to file a joint application with her consent. And also You must present strong legal precedents to the High Court.
