Ex parte decree related question

05-Oct-2025 (In Divorce Law)
Hi, I received an ex parte decree of nullity of marriage from the court. I am the husband, petitioner. Is it mandatory to inform the respondent about the decree? Previously multiple summons were served which were received by the respondent and paper publication was also done. My lawyer didn't ask me to do anything as such.

No, it is not legally mandatory to inform the respondent after the ex parte decree if proper service of summons and publication was already done. However, it is advisable (not compulsory) to serve a copy of the decree to the respondent to prevent future claims of ignorance. If the respondent doesn’t act within 30 days of knowledge of the decree, their right to challenge it under Order IX Rule 13 CPC may be barred.

If your conducting lawyer has not asked you to do anything, then why worry about it. Your lawyer is well aware of the facts and circumstances of your entire matter of ex party decree of nullity of marriage... paper publication.... multiple summons.

if you have got the decree itself, there is no need to inform the respondent. the order of the court has already been passed. however, if you are willing to intimate the respondent about the decree then you can inform, but there is no such necessity.
