You may file for divorce on the ground of mental cruelty if there is harassment and incompatibility. The petition can be filed in the Family Court where you reside or where you last lived together. A joint loan does not prevent divorce, but repayment liability will continue as per the loan agreement.

“I wish to seek legal advice regarding the filing of a divorce petition in India on account of serious marital incompatibility and irreconcilable differences between the spouses. Due to continuous disputes and lack of mutual understanding, it has become impossible for the parties to continue the matrimonial relationship. Kindly advise on the appropriate legal remedy and procedure for initiating divorce proceedings under the applicable law.” If the marriage was solemnized under Hindu Marriage Act, 1955, the petition is generally filed under Section 13 (contested divorce) or Section 13B (mutual consent divorce). If the marriage was registered under Special Marriage Act, 1954, the divorce petition is usually filed under Section 27 or Section 28 (mutual consent).

To file for divorce you need to give him a legal notice on the basis of that legal notice if he is ready to give mutual consent divorce then it will be done in 4 to 5 dates but if he is not ready to give you divorce then you need to file a contested divorce for that you will be required to file divorce petition in the family court or District Court of your jurisdiction where do you reside on the basis of that jurisdiction will be decided.
