Now lawyer says there are no defect and asking to wait. Is he lying? Can I check myself without him?. I had prepared the draft petition still he took 1.5 months to file and now this. Please advise.

According to you, you filed a divorce case on 14th August. After filing it, did you get a hearing date and a filing number? You can check this through the e-Courts portal by using your filing number or name. If you need proper advice, please share your case details and the grounds on which you filed the case. Is it contested or mutual? kindly share.

The fact that the case status shows “Defect Removal” does not by itself mean that your lawyer is lying. It generally indicates that defects were pointed out during scrutiny and the matter is/was pending for removal of those defects. If the lawyer says there are now no defects, ask him for the filing/registration number and the defect memo or scrutiny status. You can also check the case status yourself through the concerned court’s official e-Courts portal, using the CNR/case/filing number, without depending entirely on your lawyer. If the matter is still shown as “Defect Removal”, ask the lawyer specifically what defects were raised, when they were removed, and whether the petition has been numbered/registered. Since you have already paid the fee, it is reasonable to request a copy of the filed petition, filing acknowledgment, and present case status. Do not accuse the lawyer of dishonesty unless the court record actually contradicts his statement.
