Domestic Violence in a foreign country

17-Jan-2026 (In Divorce Law)
I am married and studied in Australia for three years. Due to my low income, my husband financially controlled me and restricted my actions, which made me afraid. I cut off contact with my family to continue my studies. Now in India, he refuses to resolve issues, is delaying the return of my Stridhan, denies past abuse, and is threatening to revoke my visa if I do not return.

A domestic violence case in a foreign country is not merely criminal or civil, but a multi-jurisdictional legal issue involving family law, criminal law, international law, and immigration law. Proper legal strategy and timely action are essential to safeguard the victim’s rights. If you want, I can also: Draft this as a legal opinion Convert it into simple English Tailor it to India-specific situations or your own case facts

Financial control, isolation, denial of abuse and threats can amount to mental cruelty. You may seek divorce on cruelty, recovery of Stridhan and relief under the Domestic Violence Act. Visa threats have no legal effect in India. Preserve evidence and initiate proceedings.

You have legal remedies in India. Financial control, isolation, threats and withholding stridhan amount to domestic violence. You can file/continue proceedings under the DV Act seeking protection, residence orders, interim maintenance and immediate return of stridhan. Threatening visa cancellation is coercion and has no automatic effect; only immigration authorities decide visas. You may also seek divorce on grounds of cruelty. Preserve evidence (messages, bank records) and seek interim relief urgently through court.

What you have described is serious and the law does protect you. Financial control, isolation from family, threats, and withholding stridhan all amount to domestic violence, even if part of it happened abroad. Your husband cannot legally cancel or control your visa by threat. You can take action in India for Domestic Violence, seek return of stridhan, protection orders, and also consider divorce if reconciliation is not possible. His denial does not stop your legal remedies, especially when your safety and dignity are involved. Don’t handle this alone. Speak to me directly — I’ll guide you on the safest legal steps and help you decide the right course without putting you at risk.
