Domestic violence , disadvantage

20-Jan-2023 (In Divorce Law)
Can I apply for DC while our mutual divorce case is in process? I also would like to withdraw our nutual consent divorce case till the DV is in process ? Does it becomes easy for the husband to win the contested divorce case (if he apply) if I fail to provide proof in DV case?

you can withdraw the mutual consent divorce case at any stage. you are free to file for a fresh case under domestic violence act. you can also seek maintenance under the same act.
your mutual divorce cannot proceed without your consent.

You need to withdraw your divorce case first if you wish to file DV. Legally speaking DV is different from Divorce cases. To make your DV case maintainable you don’t need anything only a simple police complaint will do or any call to 100 no. while you were in your house.

If you are going for mutual consent divorce, then make sure that first all pending cases are withdrawn and only then go for recording of statements. Otherwise there’s no point going for a mutual consent divorce.
