Domestic violence and divorce / alimony

I had a past relationship before marriage and my husband knows about that, but after one year of marriage he is not accepting that past relationship. Because I had some conflict with my inlaws, they removed me from home 3 times and sent my luggage to my home. I filled a complaint against him in women cell, he denied to keep the marriage. My inlaws are having all my jewelery . can I get all my jewelery back and also the alimony from mutual divorce. And if not from much time does contest divorce

Yes, you can claim all your jewelry vide mutual consent divorce. Divorce by mutual consent is less time consuming whereas a contested divorce takes time which may be anywhere around 4-6 years or even more sometimes. Feel free to contact me for seeking any legal advice as regards the same.

yes you will get back everything which has been given in the marriage also file the case according to your statement and for that you need to discuss everything remedies available in the law where you will get the justice

Hi You can file a complaint under Domestic violence Act, 2005 before Magistrate court. @ seek residence rights. @ Monetary relief @ protection order @ compensation order File FIR under section 498 A, section 406, Section 323 / 504 / 506 File Maintenance under section 125 Crpc Lastly you can file for Divorce and streedhan ( your jewellery) Recovery

Yes, you can definitely ask for your jewellery as it is your personal property which was gifted to you during your marriage. They have no right to keep it back. Sending you away from the house and your belongings uninformed also amount to certain level of mental harassment that can also be pleaded, legally. alimony, and maintenance be it by mutual consent or a contested totally depends on the facts of the case.
