If they have decided to dissolve the marriage, it may not be possible to continue the relationship. However, you have two legal remedies available — one is to seek restitution of conjugal rights, and the other is to claim maintenance from your husband. Even if the family court grants a decree for restitution of conjugal rights, no court can compel your husband to live with you against his will. Nevertheless, you are entitled to receive maintenance from him until you remarry.

completely understand your situation. Since you do not want divorce and wish to continue your marriage peacefully, you should immediately submit a written reply (objection) to the divorce petition filed by your husband, clearly stating that you do not consent to divorce and that you wish to save your marriage. This will ensure that the court does not treat the case as “mutual consent.” You can also file a petition under Section 9 of the Hindu Marriage Act, 1955 for Restitution of Conjugal Rights (RCR) before the Family Court, requesting the court to direct your husband to resume cohabitation and fulfill marital obligations. At the same time, you may continue to seek protection under the Protection of Women from Domestic Violence Act, 2005, requesting counseling, protection, and residence orders through the Mahila Thana or Protection Officer. The counseling cell can also assist in reconciliation efforts under court supervision. Keep all previous police complaints, counseling records, and any evidence of violence safely — they will help you show that you have always acted in good faith to maintain the marriage while protecting yourself from abuse.
