divorce petition alongwith maintenance request

my husband remarried. i want to file divorce case against my husband and request maintenance to be provided for me and my child. if he doesnt show up before the court, will the court allow me maintenance? or is it mandatory to file for maintenance separately?

you can file for interim alimony in the divorce case and also for permanent alimony and can also file separate case for maintenance. However your husband's second marriage without divorce from you is void.
