Divorce matter - how to ask for Compensation ? duration for mutual?...

15-Jul-2025 (In Divorce Law)
I have sent my husband a divorce notice, and in his response, he has agreed to proceed with a mutual divorce. However, I wish to claim compensation for the mental, emotional, and financial distress I have suffered. What should be the content of my next notice? Should I directly mention the compensation amount in it?

If a person is ready for a mutual consent, then whatever your claim and demands are their should be described and mentioned in writing and if her agrees thn surely you can move for mutual consent and if not then Contested is the option for you

Put a proposal of your demand of permanent alimony before him and if he is ready for it then mention all the details in the divorce petition u r going to file by mutual consent. there is no need to send second notice

I can aware you with the exact contents you write in it, but you need to be careful while drafting such notice, as it has evidentiary value in Court. It is not advisable to directly mention the compensation amount in it, so it doesn't sound unethical and illegal, will guide you how to write in a legal manner.

Have an informal discussion between you and him in the presence of family elders, if possible. You can try to arrive at a mutual understanding regarding the divorce and agree on a reasonable compensation amount. If he refuses to offer any compensation, you have the option to proceed with a contested divorce through the court.

Since your husband has agreed to proceed with a mutual divorce, you are well within your rights to seek compensation for the mental, emotional, and financial distress caused. In your next notice, you should clearly mention the compensation amount you're claiming, along with the reasons for such demand. This can be included in the mutual settlement terms to be filed before the court. Ensure all terms such as alimony, maintenance, stridhan return, and any one-time compensation are well-documented to avoid future disputes. For a strong and legally sound draft, professional assistance is recommended. You can connect with me through my profile for further support. Regards, Adv. Afreen Vindhani
