Divorce case between my friend and his schizophrenia wife

17-Jan-2024 (In Divorce Law)
My friend married a schizophrenic and she refuses to leave him. The case is running for four years. He asked for compensation for cheating him but his father in law is ready to give him the property but he wants him to live with his daughter. He is frustrated as his inlaws are trying to give money to make him live with his I'll daughter. He was cheated and married. Kindly give a legal advice what if she refuses to give divorce.

Sir, your friend will have to contest the case. If there is medical proof about her disorder you can seek for nullity of marriage as well. Since the case is already pending, you will have demonstrate to the court about the illness/ disorder and also inform about lack of informed consent of your friend to the marriage.

hi alocious here, I can well understand your concern from your query raised, Though section 13 of the marriage act provides for dissolution of marriage for unsound mind, schizophrenia cannot be construed as a sole ground for divorce, and it changes from case to case, you can contact me for further clarifications, thank you
